Acceptance of these terms

These Terms of Service (the "Terms") govern your access to and use of the websites, applications, and services provided by SUPERVIVID LLC ("Supervivid", "we", "us"), including supervivid.ai and all tools available through it (together, the "Service").

By creating an account, purchasing credits, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" refers to it.

The service

Supervivid is an AI creative suite that lets you generate and edit video, images, and music from text prompts and uploaded media, using a curated set of state-of-the-art generative models. Features include, among others, AI video and image generation, music generation, face swap, motion control, lip sync, upscaling, and inpainting.

The Service evolves quickly. We may add, change, or remove features and models at any time, including models provided by third parties that become unavailable to us. We will use reasonable efforts to avoid disrupting paid functionality, but we do not guarantee that any specific model or feature will remain available.

Accounts & eligibility

You must be at least 13 years old to use the Service, and at least 18 (or the age of majority where you live) to make purchases. If you are between 13 and 18, you may only use the Service with the consent of a parent or guardian.

• You must provide accurate account information and keep it up to date.
• You are responsible for all activity under your account and for keeping your credentials secure.
• Notify us immediately at [email protected] if you suspect unauthorized use of your account.
• One person or entity per account; accounts may not be shared, sold, or transferred.

Credits, subscriptions & refunds

Credits

Generation on Supervivid consumes credits. Credit costs vary by model, resolution, duration, and feature, and are shown before you generate. Credits are a limited license to use the Service — they are not money, have no cash value, and are not transferable or redeemable.

Subscriptions

Paid plans renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current period, and you keep access until then. Prices may change, but we will give you advance notice before a change applies to your renewal.

Refunds

Because credits are consumed by compute that we pay for immediately, purchases are generallynon-refundable once credits have been used. If something went wrong on our side — a failed generation, a billing error, duplicate charges — contact us and we will make it right, typically by re-crediting your account. Full details, including the 14-day window for unused purchases and EU/UK withdrawal rights, are in our Refund Policy. Nothing in this section limits any non-waivable statutory rights you have in your country.

Your content & generated output

Input

You retain all rights to the prompts, images, video, audio, and other material you upload or submit ("Input"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and transmit your Input solely as needed to operate and provide the Service — for example, sending it to the model you selected to run your generation.

Output

As between you and Supervivid, you own the video, images, and music the Service generates for you ("Output"), to the extent permitted by applicable law, and you may use it commercially. You are responsible for how you use Output, including verifying that it does not infringe third-party rights and that your use complies with the law where you publish it.

Responsibility

You represent that you have all rights needed to submit your Input — including consent from any identifiable person appearing in media you upload — and that your Input and intended use of Output comply with these Terms.

Acceptable use

You agree not to use the Service to create, upload, or distribute content that:

• Is illegal, or promotes or facilitates illegal activity;
• Sexualizes or exploits minors in any form — this results in an immediate, permanent ban and a report to the relevant authorities;
• Depicts a real, identifiable person without their consent — including face swaps, voice clones, and intimate imagery — or is intended to deceive people about what a real person said or did;
• Is intended to defraud, defame, harass, or incite violence against any person or group;
• Misrepresents AI-generated media as authentic footage in contexts where that matters, such as news, evidence, or political advertising;
• Infringes copyright, trademark, publicity, or other rights of any third party.

You also agree not to:

• Probe, scrape, reverse-engineer, or interfere with the Service or its infrastructure;
• Circumvent rate limits, credit accounting, or safety filters;
• Resell or provide automated access to the Service without our written permission;
• Use Output to train competing generative models where prohibited by the underlying model provider's terms.

We may remove content, suspend generations, or terminate accounts that violate this section, with or without notice depending on severity.

Third-party models

Many generations on Supervivid run on models operated by third-party providers. When you select such a model, your Input is processed by that provider under our agreements with them. Some models carry additional usage terms from their providers; where that is the case, we surface them in the product. Model availability, pricing, and capabilities are controlled by providers and may change without notice.

Intellectual property

The Service itself — including our software, design, branding, and everything other than your Input and Output — is owned by SUPERVIVID LLC and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. "Supervivid" and our logos may not be used without our prior written permission.

Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Generative AI is probabilistic: we do not warrant that Output will be accurate, appropriate, free of artifacts, or suitable for any particular use, or that the Service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, SUPERVIVID LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the Service will not exceed the greater of$100 or the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. If we terminate your account without cause, we will refund the unused, prepaid portion of your subscription. Sections that by their nature should survive termination — including ownership, disclaimers, and limitation of liability — survive.

Changes to these terms

We may update these Terms as the Service evolves. For material changes we will give notice — by email, in-app notice, or a prominent posting — at least 14 days before the change takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. The "Last updated" date above always reflects the current version.

Governing law & contact

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, and both parties consent to their jurisdiction, except where the law of your country of residence gives you a non-waivable right to a different forum.
